1. Who This Policy Applies To

This Privacy Policy explains how BUILDher (“BUILDher,” “we,” “us,” or “our”) collects, uses, discloses, retains, and protects personal information when you use the BUILDher Portal, contact us, enroll in a BUILDher program, or otherwise interact with our services.

It is designed for Canadian users and is intended to align with applicable Canadian privacy law, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws. Depending on where you live, additional local rights may apply.

2. Personal Information We Collect

We collect information needed to operate the Portal, deliver coaching, communicate with you, and meet legal obligations. This may include:

· Account and contact information: name, email address, phone number, username, password, age or date of birth, and account preferences;

· Program and wellness information: goals, check-ins, nutrition information, workout activity, body measurements, progress photos, weight data, habits, lifestyle information, and information you choose to share with your coach or community;

· Communications and community content:messages, support requests, call participation, comments, questionnaire responses, and content you submit;

· Device and usage information: IP address, device type, operating system, app version, browser type, log information, pages or features used, timestamps, crash diagnostics, and identifiers generated by the app or device; and

· Connected-service information:information shared when you choose to connect an approved coaching, fitness, calendar, communication, or similar service, subject to that service’s settings and privacy policy.

Some wellness, progress, and photo information may be sensitive personal information. Please share only what is relevant to your coaching and only through approved BUILDher channels.

3. How We Collect Information

We collect personal information directly from you when you create an account, complete forms, use the Portal, communicate with us, or participate in coaching or community features. We may also receive limited information from service providers and integrations you choose to use, such as app platforms, analytics tools, or connected coaching platforms.

4. Why We Use Personal Information

We use personal information to:

· create and manage your account and provide Portal access;

· deliver coaching services, workouts, check-ins, support, and relevant program content;

· prevent fraud, misuse, and unauthorized access;

· communicate about your account, program, support requests, policy updates, and—with consent where required—promotions;

· maintain the safety, security, reliability, and performance of the Portal;

· understand how the Portal is used and improve our services, content, and member experience;

· enforce our agreements, protect the rights and safety of members and BUILDher, and comply with law; and

· respond to legal requests and resolve disputes.

We rely on your consent where required by law. We may also use information where needed to perform our agreement with you, meet legal obligations, or pursue legitimate business purposes permitted by applicable law.

5. When We Disclose Personal Information

We do not disclose personal information to third parties for their own marketing purposes. We disclose personal information only as reasonably necessary for the purposes described in this Policy, including to:

· Coaches and authorized BUILDher personnel who need the information to deliver or support your services;

· Service providers that support hosting, app delivery, data storage, analytics, customer support, communications, and security, under contractual duties to protect information and use it only for authorized purposes;

· Other members when you choose to post or participate in community features—please do not post sensitive information you do not want visible to the authorized community;

· Professional advisers, insurers, or successors where necessary for business operations, a merger, transfer of control, or reorganization; and

· Authorities or other parties where required or permitted by law, to respond to legal process, protect safety, prevent fraud, or enforce our rights.

6. International Processing

BUILDher and its service providers may process, store, or access personal information in Canada, the United States, or other countries where our providers operate. Information processed outside your province or country may be subject to the laws of those jurisdictions and may be accessible to courts, law enforcement, or regulators there. We use reasonable contractual and organizational safeguards when engaging service providers that handle personal information.

7. Retention and Security

We keep personal information only as long as reasonably necessary to provide services, maintain business records, meet legal and contractual obligations, resolve disputes, and enforce agreements. The retention period depends on the information and context. When information is no longer needed, we delete, anonymize, or securely dispose of it, subject to backup and legal retention requirements.

We use reasonable administrative, technical, and physical safeguards designed to protect personal information against loss, theft, unauthorized access, disclosure, copying, use, or modification. No online service can guarantee absolute security. Keep your login credentials confidential and notify us promptly if you believe your account has been compromised.

8. Your Choices and Privacy Rights

Subject to applicable law, you may request access to, correction of, or information about the personal information we hold about you. You may withdraw consent for certain uses, opt out of marketing communications, or ask questions about our privacy practices. Withdrawing consent may affect our ability to provide some features or services.

9. Children and Minors

The Portal is not directed to children. We do not knowingly collect personal information from anyone under the age of majority in their jurisdiction without the consent of a parent or legal guardian where required. If you believe a minor has provided personal information without appropriate consent, contact us and we will take appropriate steps.

10. Third-Party Links and Services

The Portal may link to third-party sites or services. This Policy does not govern those third parties. Review their privacy policies before providing them with personal information. BUILDher is not responsible for third-party privacy practices.

11. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes to our practices, services, or legal requirements. We will post the updated version here and change the “Last updated” date. Where a change is material, we will provide additional notice as required by law. Your continued use of the Portal after the effective date is subject to the updated Policy.
